Terms and Conditions

For the avoidance of doubt, and to make things absolutely clear, some legal stuff is unavoidable.  I have tried to keep this as simple as possible.  Standard Ts and Cs for coverage of an event by fotoboat  follow below, and can be seen in Word form (and downloaded if required) here. 

Interpretations:

“Fotoboat” is a trading name of Michael Rice Consulting Limited (MRCL).  The Director of MRCL and principal operator of Fotoboat is Michael Rice.

“the Company” means Fotoboat. 

“the Club” means the organisation which has requested Fotoboat to cover the Event.  This will normally be the host sailing club for the event, or it could be a class association, or an inter-club committee in the case of a regatta organised by more than one club.

“the Event” means the yacht race or other event the Club has requested Fotoboat to cover.   Scope, timing and duration of the event shall be as defined in the Sailing Instructions or equivalent issued for the Event.

What Fotoboat agrees to do:

1. Take photographs of the Event on and off the water, at the Company’s discretion,  as agreed between the Company and the Club and as agreed between the Company and individual participants at the Event.
2. Publish the photographs on the Company’s website at www.fotoboat.com, normally within 48 hours of the end of the Event.
3. Arrange for the delivery of prints and other products ordered through the website, at the prevailing prices.
4. Be contactable during the Event by mobile phone or VHF radio, if appropriate, on the channel used by the Event.

What the Club agrees to do:

1. Provide Fotoboat with access to the Club premises and facilities during the period of the Event.
2. Provide Fotoboat with facilities to launch the Company’s boat or:
3. Provide Fotoboat with on-the-water access to the Event, such as providing a place on the Committee boat or other craft supporting the Event.
4. Publicise Fotoboat’s coverage of the Event by displaying and distributing the Event leaflets provided by Fotoboat.
5. Provide Fotoboat with copies of Sailing Instructions, entry lists, results lists and other relevant information pertaining to the Event.

Intellectual Property

The copyright of all photographs taken by Fotoboat at the Event will belong to Fotoboat.

Disclaimer

The Club will not hold Fotoboat responsible, nor will Fotoboat accept any responsibility, for any failure, or perceived failure, to produce photographs of an acceptable standard.
